As of July 2024, the Polish Embassy in New Delhi has introduced updated guidelines for individuals applying for a work visa. The new regulations aim to streamline the application process and enhance transparency. Applicants must now schedule their visa appointments through the embassy’s online portal, ensuring all necessary documentation is uploaded prior to the appointment. Additionally, the embassy has introduced a mandatory pre-application consultation to assist applicants in understanding the requirements and to minimize errors. These changes are designed to expedite processing times and improve overall efficiency, reflecting Poland’s commitment to fostering international employment opportunities.
This is indeed a good news for all the applicant. Hope this will help them to avoid scammer who was selling fake dates and making fake Work Permits.
Submit an application for approval of the unit for the purpose of receiving foreigners
The Act of 22 February 2019 amending the Act on Foreigners and certain other acts (Journal of Laws item 577) imposed new obligations on the Minister of Internal Affairs and Administration. According to the new provisions, the Minister of Internal Affairs and Administration approves, extends the approval period or withdraws the approval of: units conducting studies for the purpose of admitting foreigners to start or continue studies, scientific units for the purpose of admitting foreigners to conduct scientific research or development work, organizational units for which a foreigner is to perform services as a volunteer for the purpose of admitting foreigners as volunteers and internship organizers for the purpose of admitting foreigners for the purpose of undertaking an internship.
Pursuant to art. 144 section 4 of the Act of 12 December 2013 on foreigners, in the wording given by the Act of 22 February 2019 amending the Act on foreigners and certain other acts (Journal of Laws item 577), the minister responsible for internal affairs approves, by way of a decision, an entity conducting studies for the purpose of admitting foreigners to begin or continue studies, when all of the following conditions are met:
The entity conducting the studies has existed for at least 5 years prior to submitting the application and during that time it has conducted business consisting in conducting studies;
This is not contrary to considerations of state defence or security or the protection of public safety and order;
The interests of the Republic of Poland do not oppose this.
An entity interested in obtaining approval should submit an application (in the form of a letter) addressed to the Minister of Internal Affairs and Administration, which should include information about its existence for at least 5 years before its submission and about its conducting activities consisting in conducting studies during that period. Documents confirming that these conditions have been met should be attached to the letter. The Minister of Internal Affairs and Administration approves the entity conducting studies that meets the required conditions for a period of 5 years, and in particularly justified cases for a shorter period, by issuing a decision in this matter.
Exceptions to the principle of approval of units are specified in Article 144, paragraph 5 of the Act, according to which the obligation of approval for the purposes of admitting foreigners for the purpose of taking up or continuing studies does not apply to:
academic universities within the meaning of Article 14 of the Act of 20 July 2018 – The Law on Higher Education and Science;
vocational universities within the meaning of Article 15 of the Act of 20 July 2018 – Law on Higher Education and Science, which are public vocational universities;
military universities referred to in art. 433 section 1 point 1 of the Act of 20 July 2018 – Law on Higher Education and Science;
public service universities referred to in art. 433 section 1 point 2 of the Act of 20 July 2018 – Law on Higher Education and Science;
universities run by churches and religious associations whose relationship to the Republic of Poland is regulated by an international agreement or statute.
Pursuant to art. 151 sec. 4 of the Act, the minister responsible for internal affairs shall approve, by way of a decision, a scientific unit based in the territory of the Republic of Poland for the purposes of admitting foreigners for the purpose of conducting scientific research or development work, at the request of that unit, when all of the following conditions are met:
The research unit has existed for at least 5 years before submitting the application and during that time it has conducted research activities independently and continuously;
This is not contrary to considerations of state defence or security or the protection of public safety and order;
The interests of the Republic of Poland do not oppose this.
A scientific unit interested in obtaining approval should submit an application (in the form of a letter) addressed to the Minister of Internal Affairs and Administration, which should include information about its existence for at least 5 years before submitting the application and conducting scientific activity independently and continuously during that time. Documents confirming that these conditions have been met should be attached to the letter. The Minister of Internal Affairs and Administration approves a scientific unit that meets the required conditions for a period of 5 years, and in particularly justified cases for a shorter period, by issuing a decision in this matter.
Pursuant to art. 157a sec. 6 of the Act, the minister responsible for internal affairs approves, by decision of the internship organizer, the admission of foreigners for the purpose of undertaking an internship, at the request of that organizer, when all of the following conditions are met:
The internship organizer has existed for at least 5 years before submitting the application and during that time has conducted activities that justify accepting interns;
This is not contrary to considerations of state defence or security or the protection of public safety and order;
The interests of the Republic of Poland do not oppose this.
The internship organizer interested in obtaining approval should submit an application (in the form of a letter) addressed to the Minister of Internal Affairs and Administration, which should include information about its existence for at least 5 years before submitting the application and conducting activities justifying the acceptance of interns during that time. Documents confirming the fulfillment of these conditions should be attached to the letter. The Minister of Internal Affairs and Administration approves the internship organizer who meets the required conditions for a period of 2 years, and in particularly justified cases for a shorter period, issuing a decision in this matter.
Pursuant to art. 157g sec. 1 item 3 and sec. 5 of the Act, the minister responsible for internal affairs shall approve, by way of a decision, an organizational unit for which a foreigner is to perform services as a volunteer, for the purposes of accepting foreigners as volunteers, at the request of that unit, if all of the following conditions are met:
The entity has existed for at least 5 years prior to submitting the application and during that time has been carrying out activities that justify accepting volunteers;
This is not contrary to considerations of state defence or security or the protection of public safety and order;
The interests of the Republic of Poland do not oppose this.
An organizational unit interested in obtaining approval should submit an application (in the form of a letter) addressed to the Minister of Internal Affairs and Administration, which should include information about its existence for at least 5 years before submitting the application and its conduct of activities justifying the acceptance of volunteers. Documents confirming the fulfillment of these conditions should be attached to the letter. The Minister of Internal Affairs and Administration approves the organizational unit for a period of 2 years, and in particularly justified cases for a shorter period, issuing a decision in this matter.

At the same time, we would like to inform you that the obligation of approval for the admission of foreigners for the purpose of taking up or continuing studies does not apply to academic institutions within the meaning of Art. 14 of the Act of 20 July 2018 – Law on Higher Education and Science (legal basis for the exemption – Art. 144 sec. 5 item 1 of the Act of 12 December 2013 on foreigners).
